CONTEST PERIOD:

The McSweeney’s Win a Trip to the Memorial Cup 2024 (the “Contest”) begins on February 1, 2024 at 12:01 AM (Mountain Standard Time) and ends on April 19, 2024 at 11:59 PM (Mountain Standard Time) (the “Contest Period”).

 

AGREEMENT TO BE LEGALLY BOUND BY THESE RULES:

By participating in this Contest, you are signifying your agreement that you have read and agree to be legally bound by these Official Contest Rules (the “Rules”).

 

ELIGIBILITY:

The Contest is only open to residents of British Columbia, Alberta, Saskatchewan and Manitoba who have reached the legal age of majority in their province of residence at the time of entry, except employees, representatives or agents (and those with whom such persons are living, whether related or not) of Direct Plus Food Group, a division of Premium Brands Operating Limited Partnership (the “Sponsor”), its parent companies, subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and any other individual or entity involved in the development, production, administration, or fulfillment of the Contest (collectively, the “Contest Parties”).

 

HOW TO ENTER:

No purchase necessary.  To enter, go to www.mcsweeneys.ca (the “Website”) and follow the on-screen instructions to obtain and fully complete the Official Entry Form (the “Entry Form”).  You must fully complete the Entry Form with all of the required information and follow the on-screen instructions to submit your completed Entry Form.

 

Once you have provided all of the required information and completed all of the foregoing steps to enter (as determined by the Sponsor in its sole and absolute discretion), you will be eligible to receive an entry (an “Entry”).

 

To be eligible, your Entry must be submitted and received in accordance with these Rules during the Contest Period.

 

ENTRY LIMIT:

There is a limit of one (1) Entry per person during the Contest Period. All eligible Entries for the Contest must be received by the Sponsor within the Contest Period, must comply with the terms hereof and must have a correctly answered Skill-Testing Question (defined below).

 

If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; and/or (ii) use multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. An Entry may be rejected if (in the sole and absolute discretion of the Sponsor): (a) the Entry is not submitted and received in accordance with these Rules during the Contest Period; and/or (b) the Entry is not otherwise in compliance with these Rules (all as determined by Sponsor in its sole and absolute discretion). The Released Parties (defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries or any other Contest-related information (all of which are void).

 

VERIFICATION:

All Entries and entrants are subject to verification at any time and for any reason.  The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry or any other information submitted (or purportedly submitted) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules.  Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.  The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s).

 

PRIZE:

There will be one (1) prize (the “Prize”).  The Prize consists of:

  • two (2) round trip economy class airline tickets (the “Flights”) departing from the closest major airport to the Prize winner’s residence (the “Departure Airport”) and onward to Saginaw, Michigan, U.S.A. (the “Destination”), including all connecting flights between the Departure Airport and the Destination airport (the “Destination Airport”, and together with the Departure Airport, the “Airports”), for the Prize winner and one (1) guest of his/her choice (the “Guest”);
  • four (4) nights’ standard hotel accommodation (the “Accommodations”), and together with the Flights, the “Trip”) in a double-occupancy room from May 30, 2024, to June 3, 2024 (the “Trip Dates”);
  • two (2) tickets for the Prize winner and the Guest to attend the 2024 Memorial Cup Semi Final game on May 30, 2024 (the “Semi-Final Game”) and two (2) tickets for the Prize winner and the Guest to attend the 2024 Memorial Cup Championship Final on June 3, 2024 (the “Championship Game”, and together with the Semi-Final Game, the “Games”); and
  • $650 Canadian dollars (CAD $650) in cash.

 

The Prize has a total approximate retail value of five thousand dollars ($5,000) based on a Winnipeg, Manitoba hypothetical departure example.  The actual retail value of the Prize will vary depending, inter alia, on the Travel Date(s) and the location(s) of the Departure Airport. The Prize winner will not be entitled to receive the balance of any amount representing the difference of the Prize’s retail value and the Prize’s actual cost, whether in cash, gift cards of any kind or otherwise. No frequent flyer miles will be available for the Flights.

 

If in the event that the Prize winner resides within a 400km radius of the Destination (as determined by the Sponsor in its sole and absolute discretion), the Sponsor will determine, in its sole and absolute discretion, whether or not the Prize will include airline travel, another form of transportation to and from the Destination, or reimbursement for certain incurred fuel costs. All decisions of the Sponsor in this regard will be final and binding without right of appeal.

 

The characteristics and features of the Prize, including the Flights, airline carriers, Airports, Accommodations and specific seating at the Games, will be determined exclusively by the Sponsor in its sole and absolute discretion based, inter alia, on its consideration of the aforementioned criteria. Government restrictions and regulations and hotel, airline carrier, airport or other transportation restrictions and regulations may apply. Type of Accommodations is subject to availability.

 

The Prize will not include, and as such the Prize winner and the Guest will be responsible for:

  • any transportation, whether ground or otherwise, to the Departure Airport prior to the departure for the Trip (including between the Prize winner’s and the Guest’s respective residences and the Departure Airport) and from the Departure Airport upon return therefrom;
  • any transportation, whether air, ground or otherwise, to the Accommodations from the Destination Airport upon arrival at the Destination and from the Accommodations to the Destination Airport upon return therefrom; and
  • any transportation, whether air, ground or otherwise, to and from the Accommodations and to and from the arena at which the Games are played. 

 

The Prize winner and the Guest must:

  • travel together on the same itinerary and have the same departure and return dates;
  • each have valid travel documents prior to ticketing;
  • have the right to exit from and return to their initial departure location and enter and exit from the Destination as well as any other possible stop-over location;
  • have at least one (1) major credit card in good standing in order to, inter alia, cover any incidentals or any other requirements at the Accommodations; and
  • comply with all applicable laws, policies, orders, protocols, and guidelines issued by federal, provincial, and local authorities, as well as those of any airline, airport, hotel, and/or arena where the Games are played, including, but not limited to, those respecting COVID-19 and other communicable diseases.

 

Travel must be booked through the Sponsor and the final booking of the Trip must take place within five (5) business days of the Award Date (defined below) (the “Booking Date”). Departure for the Trip must take place by May 30, 2024 (the “Travel Date”) and the Trip must take place during the Trip Dates. For greater certainty, the Trip cannot be booked after the Booking Date and travel cannot occur outside the Trip Dates. Once booked, a reservation for the Trip may not be rescheduled, changed, extended or substituted. Some additional restrictions may apply.

 

For greater certainty and without limiting the generality of the foregoing, the Sponsor will not be responsible for any other expenses not specifically mentioned herein related or incidental to the receipt and use of the Prize, including without limitation, any transportation other than as described above, meals and beverages, airport and departure taxes, any other taxes, surcharges or fees, insurance (including baggage, travel and medical), telephone (including long distance charges), internet or fax charges, personal services or expenses such as laundry, valet, room service, gratuities, items or other expenses of a personal nature, any additional hotel accommodations, optional tours or excursions, and any other costs not specifically mentioned herein as forming part of the Prize, all of which will be the sole responsibility of the Prize winner and the Guest.

 

For greater certainty and without limiting the generality of the foregoing, it is understood that the Sponsor reserves the right, in its sole and absolute discretion, to change any element of the Prize in the event that reasonable airfare or the Accommodations cannot be obtained or in the case of any other circumstances beyond the Sponsor’s control.

 

The Prize winner and the Guest must have valid passports required to travel outside of Canada. Failure to comply with all travel, event/activity and accommodation rules and regulations, including but not limited to any that may be imposed by an act of government having jurisdiction over the departure/arrival countries, provinces, states and/or cities, may result in the forfeiture of all or part of the Prize and Sponsor will not have any obligation to provide any compensation in respect thereof. Travel restrictions, conditions and limitations may apply. It is recommended that the Prize winner and the Guest obtain sufficient personal insurance prior to departure. The Prize is subject to any travel advisories that may be issued by the government of Canada and the government of the United States of America.

 

Admission to the arena at which the Games are played is subject to all rules, requirements, and policies, including, without limitation, all security, fan conduct, and safety and health requirements and policies, put in place by the Canadian Hockey League and the arena at which the Games are played, including requirements relating to face masks and enhanced health screenings (which may include a requirement that ticket holders be tested for COVID-19 prior to or during any Game or provide proof of full vaccination against COVID-19 prior to attending any Game) as they may be updated from time to time. Attendance at the Games is conditioned on such compliance, as well as compliance with all applicable laws, policies, orders, protocols, and guidelines issued by federal, provincial, and local authorities respecting COVID-19 and other communicable diseases.

 

The Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion).  No substitutions except at Sponsor’s option.  Sponsor reserves the right, in its sole and absolute discretion, to substitute this prizing or a component thereof with a prize of equal or greater retail value, including, without limitation, but at Sponsor’s sole and absolute discretion, a cash award. No component of the Prize may be returned after pick-up. Items comprising the Prize cannot be changed, except in the Sponsor’s sole and absolute discretion. No rain checks will be provided. The Prize is non-refundable, non-transferable and may not be reissued or revalidated. The Prize cannot be combined or used in conjunction with any other contest or offer.

 

PRIZE WINNER SELECTION PROCESS:                                                        

On April 22, 2024 (the “Selection Date”) in Calgary, Alberta at 12:00 PM Mountain Time, one (1) eligible entrant will be selected by random draw from among all eligible Entries submitted and received in accordance with these Rules during the Contest Period and such selected entrant will be deemed the potential Prize winner.

 

If for any reason the Games are cancelled prior to the Selection Date, the Sponsor reserves the right, in its absolute and sole discretion, to cancel, terminate, modify or suspend the Contest.

 

The odds of winning depend on the number of eligible Entries submitted and received in accordance with these Rules during the Contest Period.

 

WINNER NOTIFICATION PROCESS:

The Sponsor or its designated representative will make a minimum of three (3) attempts to contact the potential Prize winner by email or telephone (using the information provided at the time of entry) within seven (7) business days of the Selection Date. If the potential Prize winner cannot be contacted within seven (7) business days of the Selection Date, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate potential Prize winner following the same winner selection procedure described above (with the necessary amendments), in which case the foregoing provisions of this section shall apply to such new potential Prize winner. The Sponsor will not be responsible for failed attempts to contact a protect Prize winner.

 

WINNER CONFIRMATION PROCESS:

Before being declared the confirmed prize winner, the potential Prize winner will be required to: (a) correctly answer a mathematical skill-testing question (the “Skill-Testing Question”) without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by email or other electronic means, by telephone, or in the Sponsor’s form of declaration and Release), and (b) execute a full release and affidavit of eligibility in a form to be provided by the Sponsor which, inter alia, relieves the Released Parties (defined below) from any and all liability for injury associated with any prize awarded to him or her, as well as satisfy any and all laws and regulations and other criteria required by the Prize winner’s province or territory of residence.

 

The Prize winner will be entitled to be awarded the Prize on the date on which the eligibility qualifications of the Prize winner have been satisfied in accordance with the Rules (the “Award Date”). The Prize will be sent to the Prize winner by e-mail, registered mail or courier to the e-mail or mailing address, as the case may be, provided by the Prize winner (a signed acknowledgment of receipt at the delivery location may be required) within fifteen (15) days of the Award Date. Tickets to the Games will be waiting for Prize winner upon arrival at the Accommodations.  The Sponsor reserves the right to modify, in its sole and absolute discretion, the method of delivery of the Prize to the Prize winner in the event that the Prize cannot be sent to the Prize winner as described in this section due to any cause beyond the control of the Sponsor. The name of the Prize winner may appear on the Website and/or any other online social networking and media marketing web pages of the Sponsor for no less than sixty (60) days following the Award Date.

By accepting a Prize, the Prize winner hereby: (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Contest Parties and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of the potential winner's name or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor. If the potential Prize winner: (a) as applicable, fails to return any required properly executed Contest documents within the specified time; (b) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; (c) fails to correctly answer the Skill-Testing Question; and/or (d) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate potential Prize winner following the same winner selection procedure described above (with the necessary amendments), in which case the foregoing provisions of this section shall apply to such new potential Prize winner. The Sponsor will have final discretion in selecting the winner in the event of a tie or for any other reason.

 

GENERAL CONDITIONS:

All Entries become the property of the Sponsor. Any entries by third parties, or generated by a script, macro or by any other automated means whatsoever (including, without limitation, any electronic, robotic or computer automated or automatic contest entry program, tool, service, script, bot, macro, system or software, whether commercially developed or otherwise), or that contain typographical errors, are altered, tampered with, incomplete, inaccurate, irregular in any way, or otherwise not in compliance with the Rules, will be considered null and void and will cause the disqualification of such entrant from the Contest and repeated violations of the foregoing may render such entrant ineligible for future contests or promotions offered by the Sponsor.

 

This Contest is subject to all applicable federal, provincial and municipal laws.  The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants.  ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.  

 

The Sponsor does not assume any responsibility and will not be held liable:

  • for weather conditions; acts of God; acts of war or terrorism; civil disturbances; local, provincial, or federal laws, regulations, policies, orders, protocols, or guidelines; strike or work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event or condition outside its control that may cause the delay, postponement, suspension, rescheduling or cancellation, or the restriction on persons attending, any aspect of the Prize;
  • in the event that the Prize winner and the Guest are denied entry to or exit from any Airport, any other stop-over location or readmission into their initial departure location;
  • in the event that the Prize winner and the Guest are denied entry into the arena at which the Games are played; and
  • for any other circumstances beyond the Sponsor’s reasonable control.

 

The Released Parties will not be liable for: (i) any failure of any website during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (v) any combination of the above.

 

Without limiting the generality of the foregoing, by participating in the Contest, each entrant hereby fully discharges and releases, and agrees to indemnify and hold harmless the Released Parties from any and all claims, demands, actions or causes of action for liability, damages, loss, death or injury, howsoever arising, which each entrant, the Prize winner, the Guest, and such persons heirs, executors and administrators may now or hereinafter have against the Released Parties related to, arising out of, or resulting from this Contest or his/her participation therein or winning a Prize (if applicable), including all damage, loss and injury which may be sustained by an entrant as aforesaid and all effects and consequences thereof.

 

In the event of a dispute regarding who submitted an Entry, the Sponsor reserves the right, in its sole and absolute discretion, to require any individual who purports to be the entrant that submitted the Entry in question to provide proof to the complete satisfaction of the Sponsor (as determined by the Sponsor in its sole and absolute discretion) of being the entrant that submitted such Entry. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification (as determined by the Sponsor in its sole and absolute discretion).

 

The Sponsor reserves the right, at its sole and absolute discretion to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud or technical failure.  Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.  The Sponsor, at its sole and absolute discretion reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever.  Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

 

By entering this Contest, each entrant: (i) expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at: https://mcsweeneys.ca/privacy-statement/); (ii) irrevocably grant to the Sponsor the right to include their name and information (including e-mail address) on any of the Sponsor’s mailing/email lists and for any live person to person calls for promotional purposes relating to the Sponsor and to use their name in any publicity carried out by the Sponsor; and (iii) agree to grant to the Sponsor a non-exclusive irrevocable license and right to incorporate, use and reproduce their photograph, voice, name, likeness, city or original hometown and province or territory of residence, in whole or in part in and in connection with the advertising, exhibiting, marketing, promotion and exploitation of its business in any manner, in all media throughout the world whether now known or hereinafter devised, including without limitation, the Website as well as any other of the Sponsor’s online social networking and media marketing web pages, and all forms of print, radio, television, home video, CD ROM, DVD, and other interactive “electronic” media, in perpetuity. Those individuals who do not wish that their personal information be used for such purposes are required to so indicate in writing to the Sponsor at the following address: Bay 1, 2355 52nd Avenue SE, Calgary, Alberta, T2C 4X7; ATTENTION: Direct Plus Food Group Customer Service.

 

This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

 

The Sponsor reserves the right, at its sole and absolute discretion to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

 

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials or website(s), including, but not limited to: an entry form, and/or point of sale, television, print or online advertising; the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law.

 

It is each entrant’s sole responsibility to notify the Sponsor in writing at the address indicated above if he or she changes his or her e-mail or mailing address or other contact information. All corrections to contact information must be received by the Sponsor during the Contest Period.

 

If any terms of the Rules are or become invalid, are ruled illegal by any court of competent jurisdiction, or are deemed unenforceable under then current applicable laws, it is the intention of the parties hereto that the remainder of the Rules will not be affected thereby and will remain in full force and effect.

CHOICE OF LAW:

All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of an entrant and the Released Parties in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
